Terms and conditions

The following terms and conditions of use govern the use of the online platform used by the the Responsible Art Market Initiative (“RAM”) www.responsibleartmarket.org (hereafter the “Website”) and apply to all users of the Website.

1. RAM Supporter Manifesto 

RAM is a not for profit initiative which exists to raise awareness amongst art businesses of risks faced by the art industry and to provide practical guidance and a platform for the sharing of responsible practices (already existing in the art market) to address those risks.RAM publishes practical guidelines and other materials on its website at Art Market Guidelines page (together the “RAM Guidelines”) and makes these available for download free of charge.The RAM Guidelines have no legal effect, do not constitute legal advice and RAM excludes any liability regarding the reference to or use of the RAM Guidelines and other materials. Art businesses are encouraged to consult with legal counsel of their choosing on the legal aspects of their operations and matters arising from this manifesto.We welcome and encourage participation in RAM’s activities by art trade and other professionals regardless of size or geography and seek to provide a neutral, independent platform for fostering dialogue and the sharing of responsible practices.RAM is not a certification or standards setting body and engagement with RAM and the RAM Guidelines (including by RAM Working Group members, RAM supporters and sponsors of RAM conferences), should not be considered certification or endorsement by RAM of these art professionals.We welcome expressions of support for our work and activities in whatever form they may take.  By choosing to support the RAM Initiative and Guidelines, supporters undertake to adhere to the RAM Guidelines and endeavour to implement them in their activities wherever applicable.RAM’s logo may only be used with our express prior permission and any reproduction of RAM Guidelines and materials (in whole or in part) should credit the RAM Initiative in full.

2. Exclusion of liability 

Under no circumstances whatsoever shall RAM be liable for any damage arising out of or in connection with the use of the Website, in particular any service interruption, external intrusion or computer viruses.RAM will not be held liable for any damage arising out of or in connection with the information, pictures and videos provided, displayed or showing on the Website, whether direct or indirect and whether arising in contract, tort or otherwise.The Website may contain links to websites operated by third parties. RAM does not control these sites and cannot be held responsible for their content or policies. Hence, a user can access and use such websites at his/her own risk. Any link or reference to any Third Party Content does not constitute an endorsement by RAM of such Third Party Content.Similarly, the Website may contain, use or display content created by third parties and information obtained from public sources (hereafter referred to as “Third Party Content”). RAM cannot guarantee the accuracy, security or reliability of any Third Party Content or guarantee that such Third Party Content will not contain any virus or any other functionalities suitable to damage the users’ data and/or property, and cannot be held responsible for any loss or damage arising from such Third Party Content or from the purchase of any products or services available on or through any such Third Party Content.

3. Data protection

Personal data of users of the Website is collected by RAM in accordance with the Swiss Federal Data Protection Act. Personal data is processed confidentially and shall not be disclosed to third parties.

4. Intellectual Property rights 

The information, pictures and videos provided, displayed or showing on the Website, and the software used in connection with the Website, may contain confidential information or information protected by intellectual property rights. Unless otherwise indicated, all intellectual property rights relating to the Website or to the information, pictures and videos provided, displayed or showing on the Website are RAM’s exclusive property and their use is forbidden, unless authorized in writing by RAM.Nothing contained on the Website should be construed as granting, by implication or otherwise, any license or right to use any intellectual property displayed on the Website. The reproduction of all or part of the Website or downloading of any information, pictures or videos provided, displayed or showing on the Website are authorized for personal and provide use only. Any reproduction or use of copies made for other purposes are forbidden.It is forbidden to modify the software or to use modified versions of software, in particular (without limitation) to obtain undue access to the service and to access the Website in another way than through the platform provided by RAM.A user who has a personal website and who wishes to add a direct link to the Website must require prior written consent from RAM. In any event, any non-authorized link to the Website must be removed on simple request of RAM.

5. Cookies 

RAM reserves the right to collect data on users of the Website, including without limitation, by the use of cookies, in accordance with the Federal Data Protection Act. Cookies do not allow the identification of users. Cookies are text files placed on a user’s computer hard drive by a web page server which allow in general to passively collect information such as the IP address of a user’s computer and/or Internet service provider, the date and time of access to the Website, the Internet address of websites from which a user links to the Website, the computer technology a user is using, his/her movements and preferences on the Website. Cookies help manage logins and monitor traffic on the Website. Cookies may also be used to collect information in connection with future visits, to recognize a user as a previous visitor and to track the activity of users on our Website. Users may set their browsers to notify them when a cookie is sent or to refuse cookies altogether, but certain features of the Website may not work without cookies.

6. Jurisdiction and applicable law 

These Terms and Conditions of Use shall be governed by and construed in accordance with the laws of Switzerland, without reference to conflict of laws provisions.Any dispute, controversy or claim arising out of or in relation to these Terms and Conditions of Use, including their existence, interpretation and/or performance, as well as to the use of the Website, shall be submitted to the exclusive jurisdiction of the Courts of the Canton of Geneva, Switzerland, subject to possible appeal before the Swiss Supreme Court.
